Bailey Zimmerman is facing a felony charge for criminal damage to property and a misdemeanor charge for falsely obtaining services stemming from an incident surrounding a scheduled May 27 concert in Albuquerque, New Mexico.
According to legal documents obtained by TMZ, the charges relate to events connected to a performance Zimmerman was set to give at Albuquerque’s Sandia Resort and Casino. At the time, the singer announced on social media that he was postponing that show — and a second on May 30 — due to illness. The affidavit tells a markedly different story.
What the Documents Allege
Hotel security at the resort where Zimmerman was staying reported that he appeared intoxicated that evening. Authorities stated he was also acting drunk during sound check, allegedly throwing microphones to the ground, tossing cymbals, and knocking over part of the drum kit. According to the documents, he stormed off stage multiple times before abandoning sound check altogether and returning to the resort.
The affidavit further alleges that Zimmerman grew upset over being transported in a white SUV rather than a black one, and that he spit in the direction of a security officer. When he arrived back at the resort, he had a bloodied knee, had lost a shoe, and required assistance from a member of his group to walk down the hallway.
The Charges and Alleged Damages
Documents state that Zimmerman was removed from the resort, and that hotel staff discovered significant damage to his room after he departed. The assessed value of that damage stands at approximately $16,000, encompassing the television, phone, walls, and carpet, along with two missing chairs. The felony criminal damage charge corresponds to that destruction.
The misdemeanor charge for falsely obtaining services relates to an unpaid alcohol tab. According to the documents, Zimmerman charged roughly $400 worth of alcohol to his room without settling the bill.
Bernalillo County prosecutors filed the criminal charges and sought an arrest warrant for Zimmerman on June 18, per TMZ. Zimmerman has been touring throughout 2026 on his Different Night, Same Rodeo Tour, which is scheduled to move into a European leg this summer. His team had not responded to requests for comment as of the time of the original report.
